Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the loyalty card service provided by Loyalty Geek Inc. (“Loyalty Geek,” “we,” “us”). By signing up for or using the Service, you agree to these Terms.

1. The Service

Loyalty Geek provides digital loyalty and rewards cards that live in Apple Wallet and Google Wallet, along with tools for businesses to manage customers, issue stamps and rewards, and send related notifications. We may add, change, or remove features over time.

2. Accounts & eligibility

You must provide accurate information and be authorized to act on behalf of the business you register. You are responsible for activity under your account and for keeping your credentials secure.

3. Fees & billing

Paid plans include a one-time setup fee and a recurring monthly (or annual) subscription, as shown at sign-up. Subscriptions renew automatically until cancelled. Payments are processed by Stripe. Setup fees are non-refundable once setup work has begun. We may change pricing on a going-forward basis with reasonable notice. Applicable taxes may be added.

4. Customer data & consent

You are responsible for the data you collect from your own customers and for obtaining any consent required to enroll them and send them notifications. We process that data on your behalf as described in our Privacy Policy.

5. Acceptable use

You agree not to use the Service to send unlawful, deceptive, or unsolicited messages, to infringe others’ rights, or to interfere with the operation or security of the Service. You will comply with applicable laws, including those governing marketing and customer communications.

6. Intellectual property

We retain all rights in the Service and our software. You retain rights in your business content and customer data. You grant us the limited rights needed to operate the Service for you.

7. Cancellation & termination

You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. We may suspend or terminate access for non-payment or violation of these Terms.

8. Disclaimers & limitation of liability

The Service is provided “as is” without warranties of any kind to the fullest extent permitted by law. To the maximum extent permitted by law, Loyalty Geek’s total liability arising out of or relating to the Service will not exceed the amounts you paid us in the three months before the event giving rise to the claim, and we will not be liable for indirect or consequential damages.

9. Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules.

10. Changes

We may update these Terms from time to time. Material changes will be reflected by updating the date above; continued use of the Service means you accept the updated Terms.
